How do I know if reported to BON or DOH

I was given a drug test because two Marinol capsules were undocumented, unwasted, and unreturned.  I forgot to waste one capsule , the other one must have been a scanning error.   I did not take these pills , and I am not impaired. I got bonuses for 100% scanning accuracy for 2 months.  I failed the drug test because I did smoke pot on vacation in Mexico (where it is not illegal) at a friends wedding the week before . I got a lawyer who wrote my resignation letter . Since I did not do anything illegal and I am not impaired the lawyer wrote that I do not have to be reported to the IPN.  The hospital HR  replied that I was terminated but did not mention reporting me. I asked my lawyer what next and the lawyer said we wait. This was a month ago and I have not heard anything from the BON nor DOH. How do I know if the hospital reported me or not ?  I asked my lawyer , but she replied that I need to pay the next $3000 of the retaining fee before she could reply .

I forgot to mention , I work in Florida 

It took 15 months for the Board to notify me of being reported.  I am in Texas.  In Texas Employers must notify the Board if they suspect an Impaired Nurse.  I don't know about the laws in Florida, nor if your former employer would follow the law.  I would find another job and deal with it if it occurs.  Unfortunately, the Board doesn't care if you were out of the country.  

It took over a year to hear from the board I my case. I believe I knew when an investigator called me to start asking questions about the situation.

What the Board hears is lack of professionalism, lack of accepting responsibility, lack of maturity, and a justification/excuse which may or may not be true but it doesn't really matter because you tested positive and that's all they need to know. 

The letter your lawyer wrote is nice but really just more of a "suggestion" and "recommendation" but it doesn't provide direction to the Board. The Board has its own rules and regulations pertaining to these type of issues.  

It could take just a few months, a few years, or maybe never (if your former employer doesn't report you) to find out...you'll just have to wait and see.
