HIPAA presentation...please help

Hi everyone.

I am a 4th semseter (senior) nursing student doing a presentation on HIPAA and the nursing implications of it. I was hoping to get some opinions on nurses on what they think of HIPAA and what kind of changes you have had to make to comply with it. What types of ethical dilemmas have you come across in regards to HIPAA and patient privacy?

I think it's great. So far I have not had any problems with it, but I understand when family members do. Many a call has come to the ER from a relative saying "My _____ is there from an accident, how is he/she?" Because there is no way to verify who the caller is, we can't say anything and I understand the feelings of frustration on the caller's part. HOWEVER.......the nurse's responsibility is to the PATIENT, not the caller.

The major problem I have with HIPAA is that no two facilities seem to interpret it exactly the same way. It is very hard to understand.

I work in a procedural area near the OR in my hospital. It is very hard to stop surgeons from just barging into the room when they want to talk to my docs, this includes GPs also. One GP went so far as to have the coordinator written up because she would not tell which room the doc was in- so he could talk to him. The best part of that incident is that doc has not been back:saint:

It is hard when you have to tell another nurse that is violating HIPAA. This OR nurse kept coming to the preop area looking at our schedule- she recognized a name on the master and wanted to see if it was a family member(she told this after her third trip over) I told her I that she was violating HIPAA by looking, and no she could not go and see. Well she stormed off and avoided any area that I might be in the rest of the day. Oh well life goes on :)
