I am wondering if it is legal to hold a midnight nurse over to day shift? Another nurse told me it wasn't but then they are being forced over to days? So if anyone knows it would be helpful.

Well - I'll say this... There were times when it snowed so dang much during my 12 hr shift that the next shift could not make it in and we had to stay over. Don't know the legality of forcing one to stay - but i do know that if you have noone to hand the patient over too, you could probably get hit with patient abandonment.

I don't know the legality of it but I've always been told we can be mandated to stay over if there isn't a nurse to replace us. Its never happened to me because on the rare times I don't have a replacement I've just stayed until they got someone to come in. Can't leave my kids without a nurse. :)
