Fired for abusing a resident

I am a CNA. I was fired because they claim verbal abuse and a mishap with a resident. She had severe dementia and was struggling during a brief change and was bruised on her hand while she was kicking and screaming. This happened 2 years ago and are adding up these instances and claiming abuse. This has been blown out of proportion. The state and the ombudsman have been informed. And I have no defence. They refuse to believe me.

  • If you have falsely been accused of elder abuse or are facing legal charges, consult with a lawyer. They can provide tailored advice and help you understand your rights. 
  • Gather any documentation related to the incidents, including your interactions with the resident, witness statements, and correspondence with your employer.
  • Get all the details of the complaint.
  • Be honest and cooperate with the investigation.
  •  If coworkers or other witnesses can attest to your account of the events or the resident's behavior, their statements could be helpful.

Professional support. Contact professional organizations or unions that support CNAs. They may offer legal assistance or advice on how to handle such situations.

  • Since the ombudsman has been informed, follow up with them to provide your side of the story and any evidence you have.

 If your CNA certification is at risk, you may need to present your case to the state regulatory board. They typically have procedures for appealing decisions or defending against allegations.

 Start looking for new employment opportunities. Be prepared to explain the situation honestly and calmly during interviews. In the future, document defensively and consider certified nursing assistant insurance.

 Consider speaking with a counselor or therapist to help cope with the stress and emotional impact of the situation.
