Hello everyone. I am waiting on a response from the BON. No response yet and my classes start this week. I am at Broward college going to get my associates in science. Then transfer to Nova to do my BSN. (4-5 years of school)
*Back in 2007 (ten years ago) I was arrested for grand theft (larceny) 1st degree. After a year of trial and the so called victim resetting the court dates , My lawyer suggested to plea no contest because I could not afford him. getting withheld adjudication.. (Adjudication withheld typically refers to a decision by a judge to put an individual on probation, as a to incarceration or other forms of criminal punishment. As a result, adjudication withheld generates a legally binding ruling of not guilty by the court system.)
I had to do 2 years of probation and community service with no trouble. Finished probation.
In 2014 I had the record expunged.
I have never had any other trouble with the law.
I do not have a felony although that was a felony charge that is expunged so I have all my civil rights.
Can I become a nurse? Have you heard of any thing like this? 10 years ago? If I am able to graduate it will be 15 years to a employer with no priors and its expunged.
I was actually on vacation from Arkansas when this happen and ended up partying with the wrong girl. I was wasted and she took me to a older mans house and he said we took his some of his property. (I did not) and when going to court I did not even know the girls real name. I met her at a 18+ club. the man was giving us liquor also. the next day I woke up in my hotel and she was gone... I was 20... Now 30.... Bad vacation.........
I always dreamed of being a nurse but I have to remember reality. I would hate to waste money on classes. I tried to go do a level 2 background check but they said I cannot do it for personal use and that I have to have a reference.
Have you heard of anything like this? I have searched and searched....

While I cannot speak to your situation, I can only offer a couple suggestions. It's good that you're thinking of this stuff now instead of having to deal with this immediately before starting school because that's when they start doing background checks. First the school will do one and you'll have at least another done as part of the licensing process. You need to be absolutely certain you have all the paperwork in hand, with multiple copies, that show the case disposition. If the BON there has law enforcement access to a criminal database, they'll be able to "see" the arrest, charge, and (hopefully) the expungement. Your past never truly goes away. LE can (usually) see everything. You may need to contact the arresting agency to find out if they have listed a disposition for your arrest. Background investigators hate to see any arrests without a disposition because those are potentially "open" charges and possibly mean more work for them to run that down. You may need to contact the court that dealt with your case to ensure that your case info and disposition are properly recorded and posted to your state's computer record system, even though the charge has been "expunged." The public won't be able to "see" the charge but remember that LE can and that may be an issue.
Even if all that happens and there's still some question about your status, that's why you need to have your paperwork, with multiple copies, so that you can send those copies to whomever requires the info so they can determine what your background status really is. If, as you claim, your state automatically lists "Adjudication withheld" as "Not Guilty" then you should be OK but have all this stuff available before you apply because this will help prevent headaches from starting in the first place.

I too live in Florida and have been down this road (same charge, same outcome) and was required to go before the board after graduating before I rec'd my sit pass to test. I was asked about my involvement and what I have done to ensure I don't make those same mistakes. When I applied to take NClex, I was required to turn in final disposition of the case and write about the nature of the incident and how I've changed my life since- I thought they would here make a determination but was then required to go before the board and explain these details. The board review was a life changing experience as I was in a room full of other candidates that had also been charged with a range of offenses. Some board members/judges are very hard on you, but it is vital they are and I can only appreciate their willfulness to protect our patients.

U were able to get ur license? What school did u go to?
