How do they determine an expert witness? Do hospitals always cover their nurses for nursing malpractice or negligence?

The nurses employer will often times tell the nurse they are covered in the event of litigation, but.....if said nurse is charged with something "out of their scope/standard of practice and/or out of hospital rules/regulations", said nurse will NOT be covered by employer liability.

I ALWAYS advise the nurse to carry seperate .

Expert witnesses are those who are experts in their respective fields. Normally ones who have testified before, authored books/publications, etc. To find one can take much effort and determination and sometimes I have them in my data bank and offer their services to the attorney-client who accepts them on my recommendation.

Have you been involved in a case where the hospital didn't cover a nurse. I am just wondering after reading about all of those medication errors on this site. What happens to nurses after that? We all know that a good nurse can make a mistake and it can have bad outcomes.

I've been involved with a few, yes. And, they were not medicaion errors. Not per se.

Not sure of the outcome with the nurses in question. Their state BON determined that.

Sure, nurses are human and make mistakes. It can happen to anyone. All the more reason to carry ones own liability.
