Effect of EB3 cutoff date on application already in the NVC

I am an Indian nurse. NVC generated fee bill last week and I have sent the fees to the attorney. Will NVC process application or will it be kept till the priority date is current? Any thoughts?

I think its EAD, employment authorization something....... it is only given to nurses already in the states and are applied for adjustment of status in a regional USCIS office, Am i right anybody?

Then it doesn't apply to me because I am still here in the Philippines.

EAD is only offered to people that are already in the US on another type of visa, while a change is status is being processed for them. It takes 90 days after the petition is submitted for this to be issued. It is not available to you if you are not in the US.

The EAD does allow the nurse to work while documents are being processed.

NVC completed processing of my application December 21, 2004. When I called up NVC, I was told to wait for 8 weeks and then my immigration lawyer will be receiving a notice (am not sure from where). What happens next after NVC completes processing of application? BTW, my priority date is April 14, 2004 (I know, I may have to wait 2-3 years for a visa number :o )

Unless you have had your interview at the embassy you will not be eligible for a visa if your priority date is after Jan. 2002. Paying the visa fee means nothing at this point.

We are on the same situation my papers are also at the NVC and was pocessed last Jan.14 2005 i called them up and say i have to wait for 8 weeks. I don't think its going to be 8 weeks it might turn out to be 2 or 3 years. Not unless the retrogression for nurses will be lifted in any near future. Let just keep our fingers cross. Very frustrating because i've been waiting for three years and work my way to finishing all the exams.

Just contine to get everything done. The ruling can be lifted just as easy as it went into place.

This is Nimisha here. Me too from India. I have got my consulate number and waiting for interview. Coz of retrogresion now things are on hold.

Just want to know about ur status are u through or still waiting? Any updates on retrogression and Rep Lantos bill Any idea when is it likely to withdraw.

NVC has completed my case review. I am waiting for packet 4. No encouraging news about retrogression.

Thanks for the reply .. In India where r u from.. Well just a sharing.. Incase the retrogression is going to last long what your alternate plan? R u thinking of UK, Australia etc?.. Do u know any sites which gives updates on Rep Lantos bill and Retrogression?
