Patient Privilege psychotherapist-patient priviledge--patient records are confidential and a court order or patient consent is needed to release patient records

You may remember this one. . .
Mendez vs. Superior Court
(1991) went all the way to the Supreme Court. There were tapes made by the psychotherapist of the Mendez brothers during their therapy sessions on which they had admitted killing their parents; during their second trial the prosecution attempted to admit their these tapes claiming the therapeutic bond had been broken when the boys had threatened to kill the therapist.

If you were in California I'd tell you to go see the movie, Changeling, because it is about the medical/mental detention laws in California. They were changed as a result of that case. Unfortunately, it is a California thing, but you might check your own state laws on legally holding people for mental health emergencies.
