Denied by BON in one state due to criminal history will another state lisc. me?

Published

I graduated from LPN school in VA and was denied a license (even though I wrote them before attending school about my criminal history). In the meantime while going through the informal hearing process -just to get denied in VA- I moved to TX and am applying for my license. Does any one know if another state will license you even if you have been denied in another state.

Each state BoN makes their own determination, based on the information you provide them as part of your application packet.

You will more than likely have to disclose that you've previously been denied a license.

You might consider pursuing having your record expunged/sealed. You'll likely still have to disclose the prior conviction but (typically) to have a record expunged/sealed you have to demonstrate rehabilitation to the court and that carries a fair amount of weight with the BoN.

I agree: just because one state said No doesn't mean every state will say No. You will not know until you try.

Another benefit about the sealing/expungement: that will limit what your employers will see about your history...because even if TX (or whatever state) does grant you a license, employers still have the option to refuse to hire you based on what they see in your criminal record. So any steps that you can take to improve your record will help.
