criminal background check?

Published

hello everyone. This is only my second post on this site, so I apologize if it is in the wrong section and a little long. I have a question about criminal background checks for clinicals. I'm in maryland, and it is my understanding that a person will only be ineligible for liscensure if they are actually convicted of a crime. My question is, would a hospital deny you admission to clinicals/a job because of a charge on your record that the state declined to prosecute?

A little background: I was assaulted in a nightclub, and when i called the police, they were pretty useless, would not arrest the other person or help in any way. They told me that I had to go to the states attorney to file the charges myself. however, the next day I decided not to attempt to file the charges and just forget it-I'm busy with school and I didn't think it would do much good anyway. Little did I know the police had recommended to the other person (a large man, while I am a 100 pound woman) to file charges against me, even though he attacked me and injured me, while suffering no injuries of his own. Needless to say I went through hell from the moment I received the summons in the mail to stand trial for a second degree assault to the moment I went to court. When I went, the charges were dropped (the actual term is that state entered a nole prosequi). Sorry this has been long winded, I just wanted to give background so everyone knows I'm not a felon (LOL)...but, will a non-prosecuted second degree assault charge on my record affect my future nursing career in any way?

questions we seem to be encountering more and more often have to do with the effects of a criminal history on nursing licensure:

  • is it possible to become licensed as a nurse if you have a criminal history and if so, can i get a job?
  • is it possible to become licensed as a nurse if you have a mip, dui, or other related charges?
  • what happens if you are charged or convicted of a crime after licensure?
  • can i go to nursing school and/or be licensed/be employed if my record has been sealed or expunged?
  • will i be able to go to nursing school and/or attend clinicals with a criminal record?
  • what can happen if i receive a mip/dui/dwi or other charge while still in school?
