Can you break a school contract due to relocation?

Published

My spouse took a job out of state and is moving in two weeks. I had planned to stay and finish out my school nurse contract. The closer it gets to his move date though the more I want to move before finishing out my contract.

I was wondering if anyone knows if you can break a contract in the middle of the school year if you have a good reason (e.g. relocating out of state due to spouse's job)? Thanks in advance!

It depends on the terms of your contract.

My contract states that I can resign from my position only with written consent from the board. I am just hoping that relocation will be a good enough reason for them to release me from the position. I just wanted to hear from other school nurses if they had (or knew of someone) left their position during a school year.

I know the previous nurse left during the school year. She turned in her resignation to the board and they accepted it. I would think relocation would be good enough reason and I would offer to help them find and interview candidates and I would offer to train someone if they find them before you leave or to be available afterwards if necessary to make for a smooth transition.

Don't wait any longer to talk to your boss about this. Unless you have a board meeting in the next few days, chances are that they may find a way to hold you to your contract, at least until the next board meeting. Your other option may be to inform then and plan on burning out any sick time you have accrued to make up the time, but they'll probably give you a hard time about doing that.

I quit mid year twice and it was not a big deal. Once I was able to give 4 weeks notice, the other time, 6 weeks. My husband always left first, and I followed once house sold. The districts understand relocated spouses.
