So when I signed my contract this time, it was for 36/week. I asked if they were GT hours. My recruitor said "no but they can only call you off twice then they pay no matter what...so I'll doubt they'll do that".
then I start the job and the travelor I'm replacing says she was called off every 2 weeks the entire contract. That she had maybe 3 weeks that she got her hours.
im nervous now because I need my 36 hrs. Period. I call my recruitor and ask for this in writing. She is now beating around the bush and is telling me she'll look into it...and it's taking her an awful long time.
my contract is with this company and it does Not say in the contract that they can call me off whenever. The company has the contract with the hospital. So I'm Not bound to that contract right? In other words, if my recruitor doesn't come back with good news for me, then I'm thinking I will need to break my contract and find one with GT hours. I don't do this for the scenery...I need to pay my bills!

If your contract doesn't mention call offs, then your hours are guaranteed. The word guarantee does not have to appear in a contract, a contract is binding (guaranteed). The hospital to agency contract is not binding on you, only the language in the contract you signed. That said, you are smart to clarify. You don't want to sue to get your shifts!
Thanks! Yes when I spoke with the travel nurse leaving and she told me that she had only worked 36hrs like 3 times I got nervous. I asked her today and she told me the call off policy Was specified in her contract. My Recruitor told me verbally that I could only be cancelled or put on call twice. I asked her yesterday to please send it to me in writing since she told me that it was listed in the contract between the hospital and the company and that it wouldn't be listed on MY contract. Hmmmm. She has not gotten back to me today. I'm not held IMO to Their contract...only the one I signed. So now I feel arguments coming on as I try to get paid 36 hrs even if put on call. Yes $2/hr won't pay my mortgage lol.
