Active Duty and being "OLD"

Hey All

Got this from my recruiter earlier................ so unfair!!!!!! We're good enough to deploy however............ WTH are they thinking???? Anyone see this occur before, and anyone got an idea how long it should last

We just got this...anyone over the age of 42 cannot go active duty.

They are dissaproving age waivers starting this month. I think its

stupid and so do a lot of other people, but it is what we have to work

with for now.

The current law (title 10) states if a person can not complete 20 years

active federal service by age 62 they do not qualify for a Regular Army

appointment. MC and DC are an exception to this rule. Our lawyer has

been going back and forth with DA G1 for some time now with this, we

have lost the battle. This law policy and regulation stands. If you

currently have applicants (not MC/DC) that are pending board results for

RA and are over the age of 42 their waivers are being disapproved. They

can re-board for OAPP.

AR 601-100, para 1-9

An original appointment as a commissioned officer in the RA may be given

only to a person who is able to complete 20 years of active commissioned

service (ACS) before the person's 62nd birthday (see 10 USC 532(a)(2)).

A person receiving an original appointment to the Medical Corps, Dental

Corps, or as a Chaplain is not subject to this age requirement

What are they thinking, 42 yr olds are right at their peak, have many years exp, already educated that they dont have to pay for, kids are already grown. they are missing out with this bs, so the govt keeps bring that age down and down, whereas the age at which we can retire keeps going up and up and up. I think I cant retire until I am close to 70 years old yet they think you cant work up to that age, or 63 or 65. age is a relative term , if you are in good shape dont drink or smoke or do drugs you at 42 or more might be in better shape that those that are younger. I have worked with some of our 35 yr old vets that look much older than I do at 43. a lot drink, smoke, and are hep c positive and look and act much older that I do. and function older than I do. what were they thinking. a 41 yr old mom won a medal at the bejing olympics in swimming, if she were a nurse she could probably out work a all of the younger ones under the table. I can work most of the younger nurses under the table.

I am expecting my orders anytime, for AR, got comissioned jan 17th wonder if this is why they are draging their feet
