will pending case of shoplifting will show in background check?

I have a pending case of shoplifting. My second hearing is on May 11, 2010. I just received a letter of acceptance to the nursing school and I have to send the acceptance letter by May 10.

The scary part comes here, I have to do background check (finger printing). "They said it could be submitted before August 18 (which is the day the classes start).

My question is, if I do my fingerprinting before May 11, will the pending case show in the background report? Will the school reject me once finds out I have a case pending (if it shows?) ... Well, the shoplifting happened this past March/10. The application was submitted a year ago. Then, I had a clean record.

My shoplifting was for candies. I put it on top of my baby stroller and I totally forgot I had to pay for them when I left the store. When the lady stoped me, I didn't even know why. Of course, no one believed me. They said the intention was there. do you think the nursing school will reject me as soon as they find out I have a pending case? I am so devastated right now.

Hi guys, in case you are interested. My lawyer said that the DA has brought it to an infraction. So I have to be there on 6/23 to plead to it.

It won't be a misdemeanor or a conviction.

However, I think this is still bad, but not as the other two above.

If this is happening to any of you? will you still bring it to the nursing advisor? Will this be something that they will kick me out of the program for fall 2010?

That's good news. It depends on the school, but it is my understanding they do the background checks so that someone who won't be able to obtain a license won't be taking up a spot in school.

What are you pleading to? Your attorney should have told you that. Again, like I said in my other posts I would do everything I could to make sure it's not a theft or shoplifting charge. Ask if you can plead to criminal mischief. Looks much better if anyone ever sees that on your record or if you have to reveal that on a job or license application.

I wanted to post my update:

1. March 2010: Got into trouble

2. April: Acceptance letter from Nursing School, --> I notified school of my problem.

3. May: I did my background DOJ and a warrant (theft) showed (pending case).

4. 6/3 court gave me an infraction (theft). Lawyer could not do anything about it.

5. 7/1 background check from school, "infraction (theft)" showed. The school used a company called "Verified Credentials" and they did it as back as 7 years.

:eek: If infraction didn't show, school would ignore it, but if it showed, it was their obligation to tell the Hospital.

6. 7/22 Hospital decided to keep me in the program. However, in January there will be a new hospital rotation and they have to get the approval to see if they accept me. I am still in hot waters.

:heartbeat I need to stay positive. I will be so busy that I won't have time to think on what is going to happen then. I will focus in school and get the best grades. I start classes on 8/18.

7. As far as jobs, that will be another bridge to get across.

Note: For those people out there. Don't get into trouble (whether you mean it or not). Pay attention to what your are doing. There are huge consequences for our actions. Not worth it.
