Well I just got kicked out of my CNA class....

so I guess it is pointless for me to continue with my RN after 3+ years of school.

I was just told that because of my background check, I could not attend any of my CNA clinicals since none of the clinics that my schools uses would accept me so this whole semester and $$$ has been wasted!!! I was also told that it would be pointless to continue with my RN degree due to the clinic thing. This is ********!!!

The only conviction I have on my record (and I am 38) is a misdemeanor for trespassing back from 94. I do have some crap on there from 1991 for burglary of a car, use of stolen CC, but all the charges were dropped, none of it ever made it to court. I also have a B.S. stalking charge from 1997 when I Ex had me arrested; she lied about the whole thing and so the court dropped the charges. I also have 13 counts of GTA from 1996, but all those charges are withheld adjudication so that means I am NOT a felon. Soooo though it looks like ****, the ONLY charge I have on my record is the stupid misdemeanor. This is ********!!!

I know that Florida just passed some new laws which pertain to criminal conduct, but none of those statues pertain to any of my past transgressions. They are directed more to medical misconduct and fraud, but like I said, I an not a felon in any regards.

I know all charges that have EVER been against you show up on background checks, even those that have been dismissed. I just have some major traffic violations from when I was 18 (driving w/o insurance, expired tags, and another one along those lines)... I plead guilty to no insurance and the rest were dismissed. I will be 30 this year, and just got a new job. Those same stupid charges still show up, even the dismissed ones. Not sure how that is legal, but evidently it is.

Well I am going to see if I can take care of it myself first. I talked the the FDLE and they said that I should not need an attorney for something like this since my charges are over 10 years old and withheld adjudication. The FDLE officer said it would cost $75, but then there is the cost of the cert copies of the disposition from the clerk of the court; none the less, it is still way cheaper than $600 for an attorney.

Yeah, that's my conclusion also. Now all employers are asking the same questions too(!) and they don't even have FBI statute authority, in FL anyway. Maybe private background companies are getting search 'pings' off of all the nursing queries(??) or they are just bluffing or BON is getting revenues from 'sharing' background information.

Anyway, I think BON is just glad to play God, suck hundreds of dollars out of you periodically, and just make you visually remember what you did a long time ago. I have not drank alcohol in 24 years and almost forgot about everything; and still cannot remember it all (what good does that do?). It is going to start make me a drinking man again!! My main sin was talking slow like a Southerner (not always why, but it nailed me 100% when drinking anything, which is NOT against the law irregardless of breath tests which were just thrown away if not high enough blowing my brains out).

Anyway, I have to get my FBI Rap sheet in 13 weeks so I can buy my sixth Amendment rights of access to information of charges supposedly up front in a timely manner. This right along with the second and fourth amendment rights illegally taken away by GW Bush are a shame. Maybe there are no more rights left, sorry to say. And if you get pinned in a biased system for predominate profit by successful convictions, too bad. Even though the judges effectively remove your case because it should have never been there, they leave it on to help their conviction 'rate'. And now State legislatures have figured out a new industry to replace manufacturing in our country: fingerprinting, background checks, fbi rap sheets, expungements, pardons (or HUGE donations to the State Governor), needless redundant NCLEX tests, and needless educational classes students do not even qualify for but are intentionally withheld from readily available information.
