Well I am so excited. I applied to the board of nursing on Saturday for my RN license (fingerprinted the same day) and received my ATT yesterday!!!!! I have a total of three misdemeanors involving the same situation but was only found guilty of one, affray(fighting). I turned in my letter of explanation and court dispostions around the end of April. I was scared that it would be lost but wanted to hand deliver it myself just to know it got there. I called yesterday just to make sure the documents were put with my application file and was told that it would take until the end of the week before I would hear anything. The call was placed at 9am and at 1pm when I checked my email my ATT was in my inbox. I was so surprised and excited and although there's still a chance of a delay even after passing the NCLEX, which I take June 3rd, this is great news for me. I've been reading this section of the site for months and was disheartened after hearing how hard of a time people were getting from their boards of nursing because of things on their background. I live in GA which I've heard is a very strict board especially on those who have a criminal background, I am glad my ATT has not been delayed and see the fast response as a good sign. I will update as soon as I pass the NCLEX on how long it takes to receive my license number. God is GOOD, hang in there anyone worried or discouraged about going through the process of getting a license with a criminal background.

I am still unemployed 11 months later after getting my license. I am hoping to get my record sealed via House Bill 1211, the new Indiana law that allows misdemeanors to be sealed after 8 years, passed July 01, 2011.

Of course, this doesn't help with the B.O.N. My view is that anything that results in a probationary license, which is any "marks", according to the I.S.B.O.N. leaves you essentially unemployable, at least in this state.

It cost me $1,000.00 to have my record sealed, and they do take care of the main databases on the internet. My attorney did tell me that some fly-by-night databases will probably still show it, but that I don't want to work for anybody that would use those for a background check anyway.

Nevertheless, all databases have 180 days to remove it, so you really cannot look for a job for 6 months, lest it pops up and your application gets thrown in the trash.

We'll see. IMHO, nursing is pretty much a wash if you have any kind of record, at least nowadays with the employment picture at present. You'll always get someone who says they know of a convict that committed murder that is working as a nurse. Few things are impossible; many things are improbable.

One thing is true: the B.O.N. is the least of your problems. They want your $50.00 and probably get a kick-back from the hosting company that gives the NCLEX. It is a very dishonest set-up. I wish you well.

Hi, I'm in the same situation here in GA. I have two underage drinking charges from '07 and '08... They were both null processed/expunged. I submitted all the court disposition papers and required paperwork anyway. I received my ATT & took the NCLEX June 3rd. I passed the NCLEX, and I have been checking the site daily since. The board was supposed to meet & review July 13th, but I still show "Pending" by the resolution to conviction status part of the list. So I have been freaking out. Does anyone have any experience with this?

Oh dear, I just saw what state you are in, the most difficult state in the union. YOUR state wouldn't even recognise my nursing college. Can you apply to the surrounding states and then later, apply for recipriosity? I know the area is drivable to other state

I hear you, and thought about that myself; however, two things I think would happen: 1) This type of thing is getting more prevalent all over the U.S.(Ohio is even worse, I am told) 2) The cat is out of the bag. The I.S.B.O.N. has issued me a probationary license, and i am sure another state would just follow suit. Sure, I could hire an attorney, but I just cannot cope with all the expense and emotional trauma anymore.

Wow, it is a dilemma, what about after this bill is passed, and what would state of Illinois say to another state? Just that it is a probationary license? At least it would be interesting to find out, there are a lot of states recruiting for nurses, Alaska is one, and maybe one state would accept. You simply won't know until you try. I wish you the best of luck, don't let this discourage you, and keep your head up high. When a door shuts, a window opens, you just have to be willing to take a chance and go out the window. Peace!

The complaint, evidently, among the legal community is that records are all over the internet and cannot be sealed, per se, so now my attorney has to summons the FBI, the State of Indiana, etc., etc.

In all honesty, I just wish I could find a field where this misdemeanor thing isn't such a big deal. They say 100,000 people in Marion County alone can't find employment due to misdemeanors, and this House Bill 1211 was meant to address that, and now the judges won't even recognize it. Amazing.

It takes time for the courts to follow statutes, I know that might not be that comforting, but you will get some relief from this. He can be appealed to a higher court or the defense attorneys might appeal, en mass, over time to make sure that statute is honored. The internet may very well have random information all over, but that is irrelevant as companies abide by the legal documents and criminal background histories etc. Like I said, whenever your state is mentioned with regard to nursing, it is the least permissive, most against all other things like the college that I graduated from would not even be recognised by your state, yet is recognised by the rest of the 49 states, no reason, just because. (Excelsior College/Albany, NY)(LPN to RN program). There are some other things your state does that just dont' make any sense, but they do seem to be very punitive and "old-school". I seriously would consider looking at the surrounding states that you live near, I do know there are many other opportunities in the other states, and even if you have to leave your home state, it might be an opportunity? Remember that every hardship is an opportunity.

You are a very kind person, Pixie. You are very encouraging. I believe you about Indiana. Evidently, they recognize it, as House Bill 1211 passed 45 to 5 in favor. So, I guess they are trying to reform.

Exactly what you said Georgia does the same. They will let u test and still deny license. I know. And I'm from Tennessee and went through Georgia Board

wow A 8 year wait for a misdemeanor to be expunged. I never heard of that long wait. I am in GA the I heard that the only time it will be a 8 year wait is if it was a felony that you would want expunged.
