I will be applying for my License approx. 4 years after I got a Petty Theft infraction on my record for shoplifting.

Do you think I will be able to still get my license?

Short answer: it's possible.

Long answer: depends on what your BON thinks. When you apply for licensure, be sure to submit all requested documentation and supporting information. Even if you're not applying for licensure this very minute, start gathering it now as it may take a while to obtain copies of any records.

Consider involving a lawyer in the whole process...in fact, should the BON ask you to come in person to discuss your criminal record, have a lawyer with you, as the BON is NOT the nurse's friend. The BON's priority is the safety of the public first and foremost. You need someone at that meeting putting your interests first and foremost...hence the lawyer.

Also, you may want to check with a lawyer to see if expungement is a possibility for your state/conviction. It won't help with the BON as you'd still have to report even expunged convictions, but it may help with the Job Search. Having a theft on your criminal record is going to make you a less-than-appealing candidate to a lot of employers.
