About 6 years ago in Colorado I was charged with a 3rd degree assault misdemeanor for protecting my unborn child. A drunk girl attacked me and I fought back. But, I was ignorant to the law a plead guilty. Now I am having a difficult time attending a RN program, because of clinicals with hospitals not accepting the charge. Is there anything I can do? And will I even be able to get my license if I can complete the RN program with a college?

Unfortunately, schools and their clinical sites have the right to refuse applicants based on their criminal record. Check with a lawyer to see if expungment is an option--that will help you with schools and the job hunt.

BONs review applicants with a criminal record on a case-by-case basis. It is possible to get licensed. Unfortunately the BON will not make a final decision on licensure until you actually apply for licensure, meaning you'll have to complete nursing school first. So yes, you'll have to take a chance on nursing school because it is possible that you'll complete school and the BON will say No.

You can still ask the BON to see if they have any guidance or recommendations for you.

Check with a local attorney regarding an expungement. This will be your best option. In most cases, schools will accept a student with a criminal past if the statutes of that conviction are past. For example, a larceny conviction mandates a 5 year waiting period in MI before a student is allowed in a clinical setting. Check these details for your case. An attorney should be able to tell you if you would be eligible to start clinical as well. As far as licensure goes, I hate to say it but the BON will decide on a case-by-case basis.
