I am in the process of applying for licensure in PA. I have a positive criminal history and I sent in my applications, background checks( they make you get your own for each state you live in, but only if you check yes to one of the criminal hx questions on the application) and sent in the court papers.

Now I guess my application is being reviewed by their legal counsel. I was wondering if anyone could shed some light On this process. Yes I know the only people who can answer legal questions is the PABON, but Has anyone ever been through this process, or know anyone who has been through this? What happened, what did they( or you) go through? Any info or anything anyone can share would be appreciated.

How long do they usually take with these matters if anyone knows.

I typed my name in the license search just because I'm obsessive, and It came back

Do you think they probably made a mistake and accidental issued that TPP? The reason I ask is because on the 9th of May I sent in all my court doc's applications, fee's, and my PA CHC and personal explanation, and I had to wait for My Ohio CHC to come back because they wanted me to get a CHC for every state that I lived in. SO my applications were pending until i got that to them.

Yesterday I received the Ohio Criminal History check(CHC) and faxed it to them. Do you think they could have had everything done that fast? I'm afraid to get excited because i thought i was going to get denied to tell you the truth, although i was honest about ever little detail. I know they are only Human and can make mistakes. At the same time i know they know what is going on and know my situation.

Well it was a mistake that they issued the Temporary Permit. A lady I spoke with at the board said somehow it "squeaked by". I don't see how when I checked the right boxes and sent in a stack of papers and had to communicate with them about my criminal record checks. Like i said though they are human and they make mistakes so of course i just have to grin an bear it. But I'm just so worried about this whole thing and for a second I thought I was on my way of becoming a nurse, reaching the dream I worked so hard for, yeah this whole thing was pretty painful. I kind of knew deep down though thats why I posted on here and asked if anyone else thought they may have made a mistake, it just seemed to easy, but then I thought " No this is the SBON i doubt this could be a mistake". The mistake was I allowed myself to get excited for a second and now I'm back where I started, I dunno, who knows whats going on. No-one responded before so I just typed this to vent, sorry

Alright time for another venting post.

Right now the status is that I am still waiting to hear something lol.

My application was being reviewed by a legal counsel for the board. I still have the Temporary Practice Permit that was accidental issued to me(5/30/08), The administrative assistant for the Board told me to "Please hold on to the permit" She would let me know the status of the permit after the initial review by counsel. I think that I showed my character by being the one to bring the fact that I got a Temp Practice permit to the boards attention, I mean someone of not so good moral character would have maybe just played dumb(I know, that is just me thinking to much). But Im scared and confident all at the same time.

For those of you who may ask about Licenses and Criminal records, here is what I know about our keystone state:

-Judged on a case by case basis

Can be refused, suspended, revoked for felony or crimes of moral turpitude(Including ARD in the disposition of felony charges).The State Board of Nursing (Board) reviews the facts of each case, the type of crime, the length of time that has elapsed since the conviction, whether any probation has been successfully completed and restitution/fines have been paid, whether or not drugs or alcohol were involved, or if the crime would be classified as involving moral turpitude Moral turpitude generally involves fraud, deceit or "...anything done knowingly contrary to justice, honesty, or good morals." (For example, a crime involving theft or fraud. )

--Law states that the applicant must furnish evidence that they are of good moral character to the PA BON

--Some areas of the law are clear. For example, the Board is prohibited by law from issuing a license for at least 10 years to an applicant who has a felony drug conviction

--Other types of felony convictions (such as aggravated assault) and misdemeanor convictions for crimes of moral turpitude are less clear, and the board has more discretion. That is why they are considered on a case by case basis.

Once you submit your application and supporting documents, they are forwarded to a legal counsel for the board for review( if you have a background). Some application are also referred to a committee of the Board

The length of time for a review is dependent upon the complexity of the applicant's background.

(This information is just from my experience and what i was told by the board)
