Repeat Monitoring Agreement

Hello all. I completed a recovery monitoring agreement as an LPN in Indiana. When I applied for a RN license, Indiana granted me a RN license. I recently relocated to Nevada. When I applied for Endorsement RN in Nevada they offered me a probationary license and a two year recovery monitoring agreement. I completed the program without incident in Indiana in 2011. I have not relapsed or had any incidents (personal or criminal) since. Has anyone else had to repeat a recovery monitoring agreement without incident? or after moving to a new state? Am I wrong to assume that if I can safely practice in Indiana that I can also safely practice in Nevada? Also, the idea is that the program move you to recovery and you stay there. Is there a reason the Nevada BON assumes their program will be more beneficial than the Indiana program? Should I be disciplined again for simply relocating? (this will be reported to NURSYS and published as part of my permanent nursing record) I consulted with a Nurse Attorney who says the Nevada BON has no case and I should receive a license without discipline or monitoring of course it will cost me $3000 for her to tell the BON the same thing on my behalf. Any advice, suggestions, or simply sharing of experience is appreciated.

Wow! That's nuts!! You would think the new state BON could assess the situation and accept the fact j that u completed your program and have cont to do what u need to do and that would be the end of it.

That's probably the most ridiculous thing I've heard yet. I know it's a lot of money for the attorney but it would be your best chance at getting a license without having to have monitoring again.

I live in Nevada and our state happens to be one of the most strict states around when it comes to being monitored. How long was your contract in Indiana? I know that Nevada put a colleague of mine on contract when she moved here from Colorado because their contractr was only 6 months (CRAZY!) and ours is 5 years for the most part. So they are giving you a break by offering you a 2 year contract. Still sucks, though.

Oh, and I just saw that it will be a probationay contract, not a monitoring one. I would fight that one. I had a monitoring one so there is no record of my being disciplined now that I have successfully completed my 5 year contract. But I know that a few of my colleagues who were on the probationary contracts have it reported to NURSYS and it will always be on there.

The Indiana contract was 3 years. Honestly, I would accept the monitoring. All that is asked of me in the contract are things I need to do to stay on the right track. My issue is with the probation. I have began to pursue graduate studies and we all know you can enter a graduate program with an encumbered license. Also I do not want where I practice to limited.

I would pay the $3000, at least there would be a better chance that you could get this situation changed.

Just feel so bad for u! That just seems nuts - u do what you're supposed to and then have to start monitoring over because u move?

On ours, it doesn't either....with the monitoring contract. For example, I was found unconscious at work under the influence. I surrendered my license and entered into their monitoring agreement. 5 years on contract, following the stipulations and I successfully was granted a full license back with my "offense" gone. If you look me up in NurSys or my board's website, it will say no discipline against my license. If I hadn't turned myself in, I would have been given the probationary contract and it stays on my license forever. Or if I had screwed up while on contract, I would have been switched to the probationary contract and again, it would be on there forever in big, bold red letters "YES" under the discipline section of my records.
