Nurses Recovery

I voluntary surrendered my RN in 2007 due to a drug charge. Am now ready to get back into nursing. I have been told by the board that I need to get into the recovery Trek program for a year and take a refresher course and then I can go to the board to see if they will allow me to get my license back. My question is is it best to get a lawyer to go with me when I go in front of the board, and if so how do I find one that is experienced in this area?

Hopefully a lawyer would not be necessary if you are compliant and participate in the recovery trek program and meet the boards requirements.

Whatever state you are in (get it in writing) has said all you need is a refresher course (sensible) and a year in a program, go for it. That's reasonable. I don't think an attorney could get you a better deal. Depending on the level of corruption in the given state, Many poor folks, no matter how old thier sins or even if said sins have nothing to do with nursing, even if they have evidence of a strong recovery still get stuck with 3 to 5 years of this mess.

I don't think I understand. Are you supposed to go through the refresher course & sign up for recovery trek for a year & then have your case reviewed by the board afterwards? If that is so I'd advise a lawyer to accompany you well versed in dealings with the BON at that hearing. I'm in group with a nurse who had a similar factual scenario as yours. They had her in recovery trek for three years and then allowed her to start PNAP which is three (more like four in actuality) years. Her total involvement will be about 8 years. If you are going to see the BON now to simply take this one-year deal snap it up!!! You don't need a lawyer and thank whoever it is you pray to that you only have to be involved in this program for a year.

I'm sorry dear but you make no sense. Maybe correct your post or offer more details. The boards of nursing in all states do not communicate by hearsay or over the phone, they do so in writing, that you have to sign and notarize. Anything that anyone from the BON tells you over the phone is considered hearsay. Only board orders count. And they only count from the dates they say it's effective. If all they want is one year of sobriety and a refresher course then what so you need a lawyer for????

This be very true. I should have capitalized the get it in writing part. I have long ago learned to document every. Single. Thing. Communicated to me by board or program because none of them can be trusted. What ever whoever on the phone might say that sounds good? You'll never be able to prove it and nobody will ever admit to that person existing.

Writing, writing, writing.....in my observance (this is an opinion and not to be considered advice or in writing) a voluntary surrender related to drugs will most certainly net you a contract and probably for more than one year.

Oh no, no, no, no.

There must be written instructions from your BON that describes, in detail, what you must to in an effort to get your license back. I would imagine it's something like submit a petition, pay a fee (because nothing happens at the BON without paying a fee) & then receive something in writing back from the BON stating what you must do to try to have your license reinstated.

I would not do ANYTHING without something in writing from the BON. I do not trust them, no way, no how. You need something in writing from the BON stating what you must do to apply for reinstatement, otherwise they will play games with you forever. The BON must tell you exactly what kind of program at Recovery Trek they want you to follow and exactly what type of refresher course they will accept.

I recommend ALWAYS appearing before the BON with a lawyer.

Yes! I am so glad I got a lawyer even though it was $3500. The board does not give you all the information or they phrase it in a way they know you won’t understand.
