I was recently caught diverting narcotics at the end of March. I came clean to my employer and resigned and entered a detox program three days later. Since leaving detox I've attended NA meetings and have been meeting with a counsellor. I was just charged with a class four felony for possession of a controlled substance. I have court on May 20 and have no clue what will happen as I've never been in trouble for anything before. I still haven't heard from the BON and my license is still active per the license look-up. I made the biggest mistake of my life and I'm doing everything in my power to get better. My question is for anyone who knows what the consequences may be for me? I know a few nurses in my area who were caught doing the same who are still able to practice. I'll feel lucky if the BON lets me go on probation with them, but is there a chance I'll get to keep my license at all? My employer has already offered to rehire me as long as I can keep my licensure. Any help or advice is appreciated!

You need to seek legal counsel, find someone who works with nurses and has a proven positive track record! Don't skimp on costs, it's worth it in the end game. Remember you get what you pay for.

As far as the BON not knowing, your manager could be in trouble for not reporting to them KNOWING you diverted.

What state are you in?? I had a felony charge too. I was able to attend drug court. After successfully completing it the charge was dropped and my record was sealed. I did voluntary surrender my license because I couldn't afford drug court fees and BON fees. When I was done with drug court I reapplied for my license and was re instated to probation for 2 years. I do know 2 other nurses that didnt surrender and were able to go to straight probation thru the BON and still work as a nurse while in drug court.
