Should I call hospitals, or send them resume, or just walk into them and ask to talk to HR manager or something?

Or should I get an attorney first? (since I don't even know what this petition looks like)

EDIT: I'm on F1 visa here now (been here for a year). Do I need petitioning at all for AOS?

I would suggest calling first as some hospitals use recruiters. If you are on F1 you still need petition so therefore currently affected by retrogression. If you are going to pay the process then I would wait until you find employer as they may prefer to use their own but that is something you can negotiate with them.

So basically, the first thing to do now is to start calling hospitals and ask them if they would like to hire me?

The petition is not just a piece of paper, there are many documents that need to be included with it. The issue that you do have is that they will not be accepting petitions for the AOS when you do get an employer at this time. You need to have the I-140 submitted before next week, and it takes over a month to get that done. You will be able to get an I-140 submitted, but the petition for the AOS will be on hold until they announce that visas are current again.

So I missed the train? Oh well... I read that although the visas themselves may not be available at the time of application, I can still get a permission to work and some kind of delay paper.... I wonder how true is that.

I plan to go to a few immigration lawyers tomorrow and see what they offer. Then I'll start calling local hospitals, there's one that has like 30 nursing job openings (long-time openings), most of them night shifts, so maybe they will agree to have me (I'd like to work nights) or if they have them just for show.

I felt so happy and relieved after passing NCLEX yesterday, and now I feel dispirited after reading many posts about hospitals not willing to sponsor anybody anymore. I hope there's still left at least one hospital in the whole U.S that hires foreign grads. :o

Sorry, but you need to be able to have the I-485 submitted to be able to get the EAD to be able to work. This is the important fact that you were not understanding. There is no other document that will permit you to work while waiting for the green card. And this opening right now is only temporary, and you must have the I-140 submitted by July 31 to have until August 17th to get the I-485 submitted.

Your issue right now is not about hospitals but the fact that there are no visas. And there have been no visas available since October 31 of last year. There is not a thing that any immigration attorney can offer you, and there are no H1-B visas for nurses if one mentions that route. Plus if there were, you still would not be able to work until April, 2008 with one of those. They only accept petitions two times per yeat, but they have not approved one for an RN in over three years.

The entire US has been under retrogression since last year. There is no reason that you cannot look for an employer now, but only the I-140 can get submitted. And that even requires a written document from the BON, not just that you passed the NCLEX exam alone. And that process usually is about 6 weeks before things are ready. We still have no idea as to when things will open again.

Unfortunately, do not expect to be working for the rest of this year. Not sure what else to tell you, but this is what is happening now. In the outside chance that you can get something submitted in October, and only outside chance, it still takes a couple of months before you can begin work. It does not happen overnight.

Suzanne, I thought I-140 could be submitted anytime, even under retrogression? I don't understand why this time you can only submit an I-140 by July 31 to be able to file an I-485. So does that mean one cannot concurrently file 140 and 485 by August 17th?

EDIT: Never mind. I just read lawrence's post linking to the new guidelines for the August Visa bulletin. But that does mean I could still file for a 140 right even though I won't be able to file for a 485?

I140 can be filed at anytime but this does not give you permission to work that is the I485. If you meet criteria to file both before the due date then you can file both but if you do not meet criteria then you can only file I140
