Considering that a foreign nurse is in the US, and has passed the Nclex. Now she finds an employer who then files for her adjustment of status during this time when there is still no retrogression. She is given a working permit and is now working. What will happen now if, while she is waiting for her adjustment of status, retrogression comes back. Will she then be denied the adjustment of status? In relation to this, are visa numbers (those 50,000 visas for nurses) counted on the basis of the number of visa applicants or on the number of visa approvals? Any information will be of so much help. thanks!
