Do I have to have a PERMANENT RN license before I can file I-140?

Hi friends:

I just got hired by a hospital in the South last week. Now I am waiting one my permanent RN license from that state. Different people told me different things regarding if I should file with a temporary or permenant RN license. I am very careful now because I may have to leave the country if my I-140 is rejected because of temporary license. I wonder anyone with actual experiences can help me here. Thanks to all the nice people here.

You may want know this. It only took me 1 month to get Visascreen. This is fast, I couldn't believe it.

For the tenth time, the only requirements for processing of the I-140 are having passed either CGFNS or NCLEX exam, as well as the English exams, if needed.

You are in the US already, so you just nedd to have the Visa Screen Certificate for when they submit a change of status for you. That is all tyou need. Since you are not believing me, have you consulted with an immigration lawyer? They will tell you the same thing..........................

But you should be having an immigration lawyer involved in your processing, so just ask him or her............................ :wink2:

If you already have legal status in the US, you are not processing an I-140, but a change in status. Since you already have one................

It is much quicker to get a Visa Screen Certificate if you are already in the US. Most people aren't.....................

Hi Suzanne: Thank you very much for the reply. I believe you, and you are very nice to help people in the forum. I really appreciate your kindness. I did see an immigration attorney. He told me I need a PERMANENT RN license, and filing for I-140 too. Immigration law is so complicated, it seems like no one knows all. I even can get different opinions from different attorneys. I just want to play safe here. Thanks.

It depends on what visa that you are currently on, to begin with. You already have a permanent license.

But I hate to tell you that your attorney is wrong..............no foreign nurse in California has a permanet license until they have their petition submitted since CA will not issue the license without the SSN#. You need to speak to an immigration lawyer who works with nurses, completely different from anything else. Also, many nurses apply for green cards with just CGFNS and English exams, that is all that is required by the US government. In no place does it say that you must have a permanent license.

Your choice, you can do what you want, but you are being given incorrect information.
