Taking pictures on nurses without permission

Nurses HIPAA

Published

Hi All,

Last night at work, one of my patient's nephew took a picture of me providing patient care to his aunt. I told him you cannot take picture of me without asking my permission. He denied taking picture but I know he did because of the flash and the clicking sound of the camera. However, I gave him the benefit of the doubt and thought nothing of it. Now, I am not so sure if I should feel secure as my ID badge was in full view. Am I wrong to feel violated or am I just being paranoid?

well, that is fine but I think they should have asked my permission. It felt uncomfortable to realize that I was being videotaped mid discharge. I would have combed my hair and put on lipstick. ;)

Check your hospital policy. We have one in place that no one can take your picture or videotape you. We have patients sign a paper which states that the visitation policy was reviewed and they agree to abide by them. If we notice someone taping we ask them to stop. If they continue then security is called.

This happened to a coworker of mine once. She is an excellent nurse who also happens to be drop dead gorgeous. She was very upset, as the patient (younger male) was already making her uncomfortable. Nothing was done, but our manager did not require her to be assigned to this patient again.

I think it's just plain wrong that what nurses want regarding the taking of pictures, is irrelevant.

Here's my guess. If a nurse had the money and time to pursue a legal avenue, the taking of pictures of nursing staff without their permission, would be just as illegal as the nursing staff taking pictures of patients.

To me it's just a matter of common sense.
