Foot Care Scope of Services

Hello. I am an RN from PA and I've started a foot care business this year (after receiving my CFCN). I am enjoying this work tremendously, and feel like I am provided a much-needed service in my area. But now I am being questioned by the State Board of Podiatry because a local Podiatrist has accused me of "practicing podiatry" and exceeding my scope of service as a nurse. I can find no specific rules/regulations justifying my practice, and the written regulations are very general. Does anyone have any suggestions about how to specifically defend myself?

Also, in an older post, yrmajesty3 (another PA foot care nurse) mentioned that in PA her business was considered a home health agency. I had spoken with the PA Board of Health, and they told me that my business would not be considered a home health agency because there were no other entities (aides, therapist, etc) working with me.

Any thoughts/suggestions?

You need an Attorney to assist you with this. You need to have all your policies and procedures in writing and the care you provide for your patient. You will have to prove that what you provide is not practicing medicine. Contact your State Board of Nursing as well to see what your NPA states about this type of work and your SOP when providing cae. Also, where you were educated and what certifications you possess.

But, first, get in contact with an Attorney who can give you the proper legal advice that you need. This could become a serious situation and without legal counsel, you could face charges of practicing medicine w/o a license.

Of course, this could all be a scare tactic on the part of the Podiatrist.

But, for your own safety and that of your license, seek legal counsel. One other thing I advise, do not discuss this with anyone other than your Attorney.
