Not working for my petitioner

Hi. I came in the US (California) through an IV EB3. When I got here, I received my permanent resident card, SS ID, and applied for reciprocity of Nursing license to start working for my petitioner as a RN. However, the California Board of Nursing denied me of a license eventhough I hold a RN license from other state. They advised me to undergo additional coursework before I can be eligible for a California RN license. None of my employer and immigration lawyer informed me beforehand about this problem with the Cali Board of Nursing. In fact, the job offered to me and presented in the US embassy back home is a RN position -So, I assume a smooth transition once I just get my visa.

My problem now is that I cannot work as a RN. My employer advised me to process for a LVN license instead and they cannot spend for my additional coursework if I really intend to practice as a RN.

I thought of going in other state since I have my permanent resident card already, and just apply for a RN job with other employer. By the way, I did not sign any contract with my petitioner and I was the one who paid for immigration services - not them. The only thing that cause me to hesistate with my plans of moving into another state is that they are my petitioner. And I thought I'll be having problems in the future once I apply for naturalization - since not working for my petitioner could be a fraud.

Need some expert advise.. thanks.

hi Juandelacruz. really? in which aspect albuquerque is more attractive than vegas? how can.u consider a place as livable? My family is in california..thats why i only have Oregon and Nevada in mind so that I can visit them regularly. It would be a great advantage of course if I work in NM - no hassle for endorsement and not that far from Cali. How many years uve been in NM?

Sorry, I didn't live in Albuquerque nor Las Vegas but spent vacation in both places.

Albuquerque to me is cleaner with a nice downtown with a lot of intact historic buildings. Housing is reasonably priced. It has all the amenities of a big city - a university, museums, theaters. Downside is that it does encounter some snow in the winter and that the chance of finding a large Filipino community is slim. However, I'm sure there are enough Asian immigrants that will allow you to find stores that sell products (food items especially) from the Philippines.

Las Vegas to me is polluted. It's identity is tied with casino industry too much and the type of lifestyle that attracts. Upside is that there are many Filipinos there.

OP, looks like you are in California now? I am also in California (SF). If you like it here in California, unfortunately, you can't compare this environment to Albuquerque as the two are very different. I realize I may be selling you a town that may not meet your ideals of a great place to live. Also, the hit show Breaking Bad has portrayed an aspect of Albuquerque that is unsavory.

Hi leemohan7..yes i have a valid VS thru CGFNS exam and a notarized job offer letter from my petitioner. .everything is complete except me passing the NCLEX exam. It was asked to me by the CO. And in my job offer letter it was indicated that the position is for a registered nurse. Since I cant apply for licensure in California because I dont have SSN yet i applied in Colorado. They waived the SSN requirement. I am hoping and praying that everything will be fine..

By the way hows ur endorsement with nevada?and what are ur plans now?all the best to you!

Thank you so much for the reply perhaps i will hope for the best that they will still consider my Nclex result under California BOn and permit me to endorse my license from n.y to cali.

Do not hold your breath, we have had several post that regardless on having a license in another state if the cases wasn't current to theory then CA have denied endorsing license. A lot will depend on when you got your nurse training

Yes, thank you silverdragon 102, i am just hoping on the fact that i originally passed the nclex under california board and just endorsed it to new york to get a license, so im hoping california will favor my request to endorse my n.y license to their state.:)
