I am wondering if anyone has had a similar experience and can let me know their timeline and how things turned out. 

When I was 16 I was caught shoplifting. I completed community service hours and the charges were dropped. This was 10 years ago and I have not had any altercations with the law since.

About 2 years ago I did a fingerprint background check on myself and saw that the arrest for juvenile petty theft still showed up. I sent in a petition to seal my record, the judge approved and I was given a copy of the court order (This all happened in California)

Fast forward to now, I applied to Texas BON for initial licensure. I applied online and checked "no" on the criminal history section because it specifically states that sealed records do not need to be disclosed. (After reading more on this forum I definitely should have checked yes, sealed or not) After over a month of hearing nothing from them and waiting for my ATT I called and was told that they were investigating my fingerprint background check. 

I explained to the lady on the phone that I potentially had a sealed record show up on the background check and asked her what the process was. She told me I could email them additional documents and that they had 30 business days to investigate. I emailed them the court order. 

I emailed them again to ask about a timeline today and was told that I was under investigation by the enforcement department and it would be a MINIMUM of 30 business days to receive an outcome letter. 

I have not received any official notice from them, everything has been on the phone or in response to an email I initiated. 

I am reading that this could take months which seems outrageous to investigate a sealed juvenile record. I am also considering sending in a declaratory order but they haven't asked me to and I don't want to further delay the process with more paperwork.

Has anyone been in a similar situation and how long was the process?

 

Hi I am in the same boat and wondering if you have any updates? I have been under my initial review since August 21st and was told initially I should have an answer 30 days from then and I called today which is 31 days and was told they still don’t have an answer and they can take as long as they want! Just wondering if you heard back yet?

Were you able to get approved. I am in the same boat. It has been 22 working days but 6 weeks with non working days. It is ridiculous. 

No I have not heard anything back I had to do the Declaratory Order and paid on 10/1/22 and still says processing not sure how long it takes but very frustrating since I already had to sit out of nursing school for 2 semesters already! Any update on your end?
