Depends on whether it is referred to the NMC and if so what action they take
If they dismiss me they will reffer to Nmc as it is company policy than how that affects me?

Hi Paloma - sorry to hear about your situation.
When a complaint is recieved by the NMC, the first thing they do is carry out an initial assessment.
The time window for an Initial Assessment is up to 16 weeks at most.
When they recieve a complaint, they'll write and inform you of it.
They also invite you to send a written response to the complaint. This is your chance to put your side of the story.
Once the intial assessment is done, the NMC decide what to do next.
The options are:
A: Dismiss the complaint
B: Refer the matter back to the Nurse's employer
C: Start an investigation
Almost all complaints are referred back to the Nurse's employer to deal with. The NMC pursue very few cases themselves.
When they're deciding whether or not to investigate a complaint, the NMC are considering two factors:
1: Is this just a single episode, or part of an ongoing or repeated pattern of misconduct?
2: Is there a risk to the safety of patients or the public?
If neither of those things are a factor in your case, the NMC will almost certainly consider it a matter for your employer to deal with, and refer it back to them.
If they've already decided to dismiss you, that's the matter closed.
Two important things to remember:
1: If you apply for any other posts while the initial assessment is being carried out, you will have to declare on your application that there's a pending complaint against you.
2: Whatever happens, the NMC will keep you informed in writing every step of the way.
It's not worth worrying at this stage about what would happen if the NMC did decide to investigate this themselves.
That's very unlikely - it would be a long time from now - and you'd get plenty of warning.
In the meantime, if you're in a union, it would probably be helpful to let your union representative know about the complaint.
Hope that helps!
