RN’s right to know who is listening to convo with patient

I have a question- I’ma Home Heath nurse and recently had to make a APS report about a caregivers’ neglect and potential financial abuse . No idea if anything has come of it. But at my most recent visit, the caregiver was home, which is very rare, and when I set up my kit on the table, I noticed that she had placed her phone partially under some clutter that I had to scoot away. Then I saw that the phone line was open and a family member was listening in to the visit. Frankly I just made it clear I was aware by directing some comments to the family member on the phone. But I do not like the idea of someone listening in and not being made aware first. Do we have any rights in this kind of situation?
