Question/Tx Corrections/non-med supv.

Published

SO, is it LEGAL in Texas to have a NON-MEDICAL supervisor.

ENOUGH so that you can use it in Court of law? I stood my ground against some unethical and ILLEGAL things I was asked to do. Was yelled at, filed a grieveance (so can we say WRONGFUL TERMINATION as was not even allowed to give info on supv. as he is hunting buddy of CEO.) (IT"S SAD BUT TRUE))

In talking to a lawyer I wonder if I SHOULD bring the board rule into this as it DOES say nurses (esp. LVN's) need supervision by MEDICAL LICENSED persons, but those this MEAN "being your supervisor".

(and YES our Dr. would stand by me)

THANKS

Wouldn't your Dr. be your medical supervision?

that's what I am asking. It would seem to me that the DR. would be the one that would have to be our supervisor, not the guy that the CEO who placed over us is. That person is a criminal justice assc. degree person, who has Never had any medical training.

Hello. You should talk to the board of nursing. But if the practice act or board states you should be supervised by a medical person, generally that would be an MD or RN. In California a non-medical person cannot directly supervise or evaluate an RN. In general LVN's will usually be supervised by an RN but laws and rules vary from state to state.

I've heard of business majors being in charge of a hospital nursing unit. They are managers and as such handle the staffing, budget, and similar issues. Now the questionable part is when the medical side conflicts with the business operations side of things. I agree that the supervisor of a medical unit should be a medical person or at least defer decisions affecting the medical aspects to someone who would be appropriate, such as the doctor on staff, but past that I dont doubt that it can be done.

Also, remember that this is Texas your talking about. Texas has a history of being business friendly, even if this particular business is a prison/jail. I wouldnt doubt that they could in fact put a non medical person in charge of a medical unit, especially in a prison. Research your suspicions, but try not to **** on any shoes while you are at it.
