If a nurse declines the first offer from a VA facility and is offered a second offer and accepts it, receives a signed acceptance letter with that amount agreed upon and. leaves an employer of 12 years and is on the new job for 8 months, and then is told that her salary is going to be reduced to the initial offer due to a HR error and you have to pay back what you were overpaid for 8 months but, we will support a waiver for the 8 months of overpayments. It was a decrease in salary of 30%. How is this allowed????

Do you have an offer letter? They can't take back money they freely offered and contracted with you. If there was a clerical error that is different.

Important thing is you have to prove there was a real offer at the higher amount.

You might want to consult a labor attorney for advice. Just a consultation, usually only costs a couple hundred. Often times you can hire an attorney for simple services.

If I was in your position I would see an attorney for advice and get a warning letter from the attorney highlighting your case to your employer. Sometimes the letter that outlines the pertaining law and your position is enough.
