overtime pay for christmas???

I'm a little aggravated right now..I've been off work for almost a week with an injury, I'm a new grad btw...So i get a call from the nurse on the floor who makes the schedule and they told me I had to work either thanksgiving or christmas. Thanksgiving happens to be my daughters birthday so I need it off so I'll be working on Christmas night @7pm I just found out that the facility where i work does not pay overtime for holidays such as christmas and thanksgiving but they pay overtime for christmas eve and thanksgiving eve. Does this make sense to anybody because it doesn't to me.:banghead: Any imput would be welcomed as I don't think this is reasonable. Again no problem with working on christmas @7pm but shouldn't I get my overtime...

nope, this is the way it is done....the eve, they work more of the holiday....by 7p on christmas the holiday is basically over....you may want to confirm that you arent working the eve, because that is usually the more valued to have off....wouldnt want to b e a no call no show

Where I used to work, on nights, Thanksgiving Eve, Christmas Eve and NY Eve were all considered the holiday, and paid as holiday pay, not overtime. The day shifters got TG day, Xmas day and NY day as holiday pay.

Thanks for the answers. I am about to begin my job on day shift and what I have read here seems to jibe with that: day shifters get day of as OT/holiday and evening/night shifters get the eve as OT/holiday.

Federal Law, the Fair Labor Standards Act (FLSA), trumps state law.

Some of the ways that health care facilities (especially skilled nursing ones) cheat workers

out of their overtime is:

1) Tell you to arrive early for report and THEN clock in.

2) Interrupt your lunch hour - even for a minute - then you are entitled to be paid for the hour

3) Make you attend meetings off the clock

4) Tell you to clock out and finish your charting or other work

5) Tell you to clock out and do the narcotics count

6) Tell you to clock out and wait for your relief.

They always threaten you with the loss of your license if you don't stay.

A group of Texas nurses has filed under the Fair Labor Standards Act to collect their overtime.

Although it talks about LVN's, documentation suggests that Med Aides, CNA's, housekeeping,

and food service will join in to collect their back money

It looks like the suit is expanding nation wide to many skilled nursing facilities.
