Help anybody,
I recently received a letter from my county stating I had a warrant for my arrest for an unpaid speeding ticket. I got this ticket October of last year and completely forgot to pay it. I called the county and they told me I owed $676 for speeding and failure to appear. I fully intend to pay the fees to remove the warrant. However, Cameron county also told me the speeding ticket is a Class C misdemeanor. When I paid the $139 BNE application fee, I stated that I did not have any convictions or misdemeanors. Please read the BNE guidelines:
Have you ever been convicted, placed on community supervision whether or not adjudicated guilty, sentenced to serve jail or prison time or granted pre-trial diversion, or plead guilty, no contest or nolo contendere to any crime in any state, territory or country, or received a court order whether or not a sentence was imposed, including any pending criminal charges or unresolved arrests whether or not on appeal (excluding minor Class C traffic violations)? This includes expunged offenses and deferred adjudications with or without a finding of guilt. Please note that DUIs, DWIs, and PIs must be reported and are not considered minor traffic violations. One time minor in possession [MIP] or minor in consumption [MIC] does not need to be disclosed; therefore, you may answer "No." If you have two or more MIPs or MICs, you must answer "Yes." You may answer "No" if you have previously disclosed a criminal matter otherwise responsive to this question in a renewal and/or licensure form.
The BNE guidelines state minor Class C traffic violations are excluded from being disclosed. The speeding ticket is considered a Class C traffic violation as per Texas Department of Transportation. Now, my question is I have already paid the $200 Nclex fee. Will this be an issue in me obtaining the permit/authorization to test letter? Will this be an issue in me testing for the NCLEX? By the way, I just graduated the LVN/LPN program on 7/27/07 which is why I am asking. Also I have not received anything from the board stating I can't test. A friend told me this should not even come out when BON runs the background check.
