I am confused. is it legal in Alabama for an LPN to allow a trained pt to draw blood from their own PICC line and hand the blood filled syringe to the LPN to be put in the correct vacutainer tube for lab processing. The pt is with a home health agency that has already been taught how to flush and admin her own antibiotics and flushes in RN absence. The LPN only took the blood filled syringe from the pt. The pt had refused allowing the LPN to draw blood per VP. Very hard stick.

Is the LPN witnessing the blood draw? Or is the blood already drawn? Have you consulted with company policy and/or the board of nursing?
If I witnessed the draw, it's not much different than witnessing an MD or other professional do an arterial draw and placing the specimen in the proper containers. I wouldn't accept a specimen I didn't witness though.
