If you work more than 40 hrs. a week are you supposed to get OT?

I sometimes work 5 12 hr. shifts a week but I don't get paid OT.

Does anyone know if there is a law that says I should get OT?

At my hospital anything over 80 hrs/ in 2 weeks is considered OT

So technically you could work 80 hours in one week and not get any OT if you didn't work at all the next week.

I'm in managment now (not nursing) and according to Department of Labor, any hours worked over 40 in a week must be paid OT. The staff I supervisor work 4-12s 1 week and 3-12s the next. They work 84 hours a pay period. According to DOL I can't even do pay periods, I must pay them for the 8 hours of OT they earned the 1 week. So they are paid for 76 hours of regular pay and 8 hours of OT every 2 weeks. The only way to get around this, I'm told, is to pay them a salary and not by the hour.

Again, where I work is not affiliated at all with nursing and it may be totally different when it comes to nursing and it may also vary depending upon the state where you live, if you signed a waiver, etc....
