I140 nightmare lawyers and immigration

Please could you help me once again:nuke:

Im an english nurse passed nclex july 05

have visascreen August 05

Job offer hospital in Florida november 05

waited for labour cert 2months at request of lawyer?

I140 submited jan2 06

I140 approved Jan6th 06 Have copy of approval notice

checked uscis website aproval date feb 6th 06 no explanation from lawyer

called nvc after 90 days no record of case

called uscis wont talk to me because im not a lawyer

called lawyer would send all docs back to uscis and ask for it to be expedited.

as of this week, called nvc yesterday still no documents recieved instructed to get lawyer to resubmit all docs.

called lawyer to check that she has, She has not worked for the company for near 2 months.

New case worker tells me that i can wait do nothing and hope the documents are found has known this to take up to a year OR PAY MORE$$$$$$$$$ to file another form which instructs someone to do something about my case.

IM trying to stay positive but feel that someone is messing me about

with all the gossip about the 50000 visas running out im feeling pretty down I believe that my case should have been included in this number it was submited in a timely manor

p.s im not with an agency have done this my self

any suggestions would be most welcome thank you trevor

The attorney's office where you started the process and gave all of the documents to needs to get off of their butt and go down to immigration and striaghten things out.

Where is the attorney located? Was the work actually handled by an attorney or a para-legal? Para-legals can be great when they are supervised with what they are doing, if not, major issues occur.

Unfortunately, I have seen it three times in just the past week. And it is a mess to clean up, but they need to take some responsibility, since they were the ones that did the filing, and it is their responsibility to follow up. It should not have to be done by you.

A couple of things are on your side, first you were born in the UK, and not from one of the countries expected to be hit by the retrogression. Things will slow up for a little while, but then things will get done quickly.

Last retrogrssion, a nurse from the UK just had the I-140 submitted in February, and had a green card in hand and in CA in August or so.

The issue is getting the attorney to follow up, it is their responsibility, not yours. You paid them to handle things and looks like they made a real mess of it.

The office is in winter park, orlando and i beleive it was a paralegal.

Ive contacted the international recruitment guy at the hospital he recommended this law firm. He said he would reaserch the matter and get back to me.

very frustrating when you have excellent free advice from this great website and expensive incompetent idiots who pretend to be experts in this matter

P.S I refuse to pay $1000 dollars for somebody to find a document that they have lost. absolute scam!!!!!!!!!!!

I agree with you 100%, the firm needs to get their behinds over to immigration asap and get it straightened out.

Just heard back from the lawyers, it seems that the only way forward is to file a I 824 form at a cost of $200 I have not come across this on the forums. do you any experience with it?

You have already paid the attorney a loarge sum of money to handle the process, they made a goof, and they need to cover it.

They can pay the $200 and they should.

Hi! I think were on the same boat...i feel so miserable.... we hired a lawyer not from a recruitment agency... my husband's I140 was approved May 4 06...but up to now not a single news from our lawyer.....sometimes I feel like he is even lying...doesn't answer my email, etc... We have already paid $4000!!! It really pains me because this is not a small amount... my husband already passed all the exams, CGFNS, Ielts and NCLEX.Even completed visa screen...but it seems it would take us longer than I thought. Still thinking positive about this.:(
