Hey everyone, I would really appreciate feed back on this. So my travel agency terminated my contract with a facility. Do I have to pay the penalty fees? I did not cancel the contract. this is a copy of what my contract says :

4) TERMINATION

The Employee acknowledges and agrees that the Company may immediately terminate this Agreement for any of the following:

  1. a) Upon the revocation, suspension, or limitation of the Employees professional license.
  2. b) Investigation or indictment by a State or Federal Agency relating to violation of any program administered by a state or
    Federal Agency.
  3. c) Breach of any obligation defined in Section 2 herein.
  4. d) Any material inaccurate statement made by the Employee.
  5. e) At the request of the Client for whom the Employee is providing services.

    -----------------------------------------------------------
Minimum Hours Worked Requirement: The Employee is expected to work a minimum of 32 hours perweek or a minimum of 416 hours per assignment. If the Employee works less than the agreedupon minimum hours, there will be assessed a $20.00 non-performance penalty for each hour theEmployee works less than the minimum hours requirement, unless prohibited by state law. Thispenalty will be deducted from the Employee's next scheduled payment or the last payment of theassignment.

As none of us are aware of either the reasons for your termination, or you contract, it is doubtful that you will get an accurate answer here. If you haven't done so, I would suggest contacting a lawyer, preferably one familiar with labor law in the state in question, regarding your liability in this matter. Prior to doing so I would not discuss this issue with anyone, and after doing so would discuss this only with her or him.

Best wishes as you work through this issue.

thank you
