DUI Years Ago - Licensure?

Hi Nurse Beth,

I received a DUI in 2009. It was my first offense and now I have a misdemeanor on my record. Since then I have a clear record except for this obstacle. I never proceeded with getting my nursing license since the first time they gave me stipulations but I am now ready to reapply. Since it has been so long do you recommend I attempt to get my record expunged first or apply again for the state boards in hopes they do not give me such strict stipulations?

Dear Had a DUI,

It's been a long time since your offence. It's time for you to move forward with your nursing career and put your past in the rearview mirror. Yes, go ahead and apply. You do not need to get your DUI expunged before you apply.

They key to receiving approval to test (ATT) for the NCLEX and your nursing license is honesty and remorse.

When you apply for your license, you will be asked for and must report your 2009 DUI. It doesn't matter whether or not it was expunged. If you conceal or fail to report your offense, your license will be denied. Keep in mind that the BON conducts an FBI level background check, and nothing is hidden from the FBI.

The BON looks at each case individually and critically. They look to see that you take responsibility for your mistake; that you are remorseful; that you are rehabilitated. You will need to write a well thought out letter to that effect. They will also ask for letters from others testifying to your rehabilitation.

Expungement can help when you apply for a job. You may not have to report expunged crimes on a job application. Be sure and follow the job application instructions.
