If you are considering legal action, consult with a personal injury or medical malpractice attorney who can evaluate your case based on the specific details and help you understand your rights and options.

It may be possible to sue for giving the wrong medication dosage, even if the correct medication was administered. However, pursuing legal action depends on several factors, including whether the mistake caused harm or injury, the specific circumstances surrounding the error, and the laws in your jurisdiction.

In such a case, you must establish that the error was due to negligence or malpractice. Key elements to prove would include:

  • Duty of care. The staff had a duty to provide proper care, including administering the correct dosage.
  • Breach of duty. The staff's actions or failure to take proper precautions led to the wrong dosage.
  • Causation. The incorrect dosage caused harm, injury, or an adverse effect.
  • Damages. You suffered measurable harm (physical, emotional, financial, etc.) due to the mistake.

Also, consider what's driving you to sue. Do you need financial help to cover any medical problems caused by the mistake? Are you upset and looking for justice?

Keep in mind that suing can drain your energy and that sometimes only lawyers win.

Best,

Nurse Beth
