CA License Revoked by Default

Published

In 2010 I lost my license by default. I was traveling and I failed to change my address with the Board of Nursing. They received a complaint about a patient that was seen in the E.R. on a day in 2006. I was the Internal Triage (aka charge nurse) and never laid eyes on the patient, but because I did not answer the board when they tried to contact me, they revoked my license. I have served a three year sentence where I could not petition the board for reinstatement. Now I am able to petition, and I have, but the board is behind on hearing its cases and I have to wait another 9 months before I can be heard by the board. So, I am hoping to return to nursing in another state. I was wondering what my chances are for getting licensed in another state. Has anyone had a similar experience?

Unfortunately, you're going to have to disclose the revocation to any state you apply for licensure in. Whether they'll go forward and license you based on that...that's really up to each individual BON that you apply to. You could drop them a note and see what they have to say...but they likely won't give you a definite answer until you apply for licensure.

This happened exactly to me earlier this year. My Cali license got revoked for misdemeanor criminal convictions and the TX BON refused to issue me an endorsement based on that. It wasn't until I took them to court for them to reverse there decision and issue me a license. It took me almost two years to get it though, but I eventually received it. You just have to continue to fight if you truly want to continue nursing.

AFAIK, every state requires one to have a valid, current, unrestricted license in order to be able to apply for licensure by endorsement. It couldn't hurt, though, to contact states you're interested in and speak to the BON directly.
