Hello, I need a sounding board right now. I have been unenployed since 10/18. I lost a job that I did not like and they made it known from day one that they did not care for me. One of the nurses that was employed there knew that I was in recovery and told everyone on my second day of the job. They pulled up my consent order and was all gathered around laughing. I was reported on that I was drinking on the job. I have never been a drinker.I had issues with narcotics in the past.The supervisior never approached me about it because he knew that they were trying to get me fired. He decided to tell me to be careful and watch my back when he was assigned to another facility and was leaving. Well after he was gone for a month, I was working with this young lady that made it known that she did not like me. She reported to the supervisor that she felt that I was under the influence of something. The supervisior did not say anything to me until the end of the day after I had worked with patients all day.When confronted I informed them that I was not under the influence of anything. I was asked to go take a drug test. I said that I would if I was going to keep my job.I was reminded by the new manager that in the past I had been accused of drinking on the job. He would not have known this because he was not even working with the company at the time. I was told that if my drug screen was clear, I would keep my job. I refused to ride with the supervisor in fear of saying something that would cost me my job. I went on my own and took the drug screen and alcohol test the same day and hour, and used their facility. The test was negative , but I was told that the supervisor stated that I cursed her out and stated that I had quit. I was upset because this never happened. They then said well we do not know what happened to that drug screen that you took.I told HR that I did not quit my job. They told me , well we can change it to termination, we do not have a problem with that.I was termed because I refused to ride with the supervisor.I was able to get my unemployment because the unemployment office stated that they were not able to prove their case.We were over staffed anyway and the nurses that were there before me felt that I should have been the person to get her hours cut because I was the last hired.I fought them and told them that the hours should be divided up among all the nurses.I was not very popular after that. Guess what , the person that reported me was terminated a week later. The employees were told that if they were caught talking to me they would loose their jobs.Yes, I told them I was seeking counsil.I did not, but surely would have if I had the money. I am ****** off and hurt. And yes, I was told by another ex-employee that they were going to report it to the board.So I reported it my self. I have not herd anything yet. My consent order is up in April, and I hope the board do not see a reason to extend it. I welcome all comments. Thanks.

They say they do now know what happened to the drug screen? But you took it in a facility that, I assume, has a CLIA approved lab (at least). They have to document that you took it and the lab that ran it must have the results. You need to go where you took the test and get the results yourself on paper.

Unfortunately, legal counsel would be a huge help to you....but I, also, would not be able to afford it.

I would imagine that if it went to investigations with the board, they would ask the results of the screen done that day. I don't think you can be reported for not riding with your supervisor....but who knows, stranger things have happened.

Did you document any of these encounters? Are/were you a member of a union?

I agree with luvche...you need an attorney. Borrow the money if necessary.

I would be livid if I were you! :devil: Absolutely get an attorney, by whatever means necessary, and track down that test. Intimidation in the workplace is terrible. There seems to be so much wrong with what happened, I certainly hope you are able to sort it out. Good luck!

Craigslist has lot of job openings for nurses, bet you could find a job within a week.
