Ex felon turned nurse

Nurses Criminal

Published

So I live in California and I just graduated from an LVN program in January. I took Nclex PN on February 20th 2017 and have not received my test results. Other students in my class received their results in a week after passing. In 2005 I had a misdemeanor for battery on spouse and a felony that has been reduced to a misdemeanor for false imprisonment in 2006. Both convictions have been expunged as misdemeanors and it's been over 10 years and I have not gotten into anymore trouble. Could this be why I haven't received my test results? Does anyone know what the wait has been like for someone in my situation? I read that if you go on breeze that you can pay for your license there, but I don't have the option to pay for my license, does this mean I failed Nclex PN?

Thanks for listening.

Did you disclose the convictions to the BVNPT? The BVNPT (and BRN) require the discloure of even expunged charges:

Enforcement FAQ - Board of Vocational Nursing & Psychiatric Technicians

If you haven't done so, contact them ASAP and rectify that, as you'll be in a world more trouble with them if you didn't disclose and they find out on their own...and given that BONs have access to DOJ/FBI records, they can.

If you've already disclosed and did all else that the BVNPT required of you...then all you can do is wait. BONs tend to take their time when it comes to applicants with a criminal history. If they ask for more info, supply it promptly.

If they ask you to appear before them to discuss your criminal record, IMO have an attorney at your side as the BON isn't your friend. They care about the public first, not you--a BON couldn't care less if you never get licensed. You need someone who will put your interests first and fight for your license on your behalf.

Best of luck.

Yes, I reported everything and submitted everything they require. I guess, I'll just have to wait. Thank you for responding and the advice.

Update:

I just received my letter from BVNPT Enforcement unit stating that they decided to grant me an unrestricted license to practice vocational nursing. Yay!!!
