Hello,

I applied to CA state board for an RN license. I've had a DUI that was reduced to negligent driving in 2009. I didn't check the box when it came to felony because it wasn't a felony charge. Later I wrote a letter to the board explaining. I called to ask about my license status and they told me it's in enforcement which is they're digging deeper in my record. I haven't had any more violations since They said I will know in a couple of weeks. Any thoughts??

My only thought is that I hope they leave you the heck alone and let you practice the profession you educated yourself for. Here in Pa. they look back at least 12 years (that's the oldest such infraction I've personally heard of) and if you had a detectable DUI they suck you into monitoring. However, I would think negligent driving would fall under the "traffic offenses" section of your criminal code and be considered neither a felony or misdemeanor. In any event I'm sure the criminal justice system in your state punished you as the laws there saw fit. Having the board punish you again seems like piling on to me but I'm pretty sure anything I say would be held in contempt by these monitoring folks. Good Luck!!!

I'm in Texas and did a declaratory statement to the BON here prior to getting my license in 2011. The DWI was from 2007. The BON had no problem with letting me sit for my exam. No monitoring program or anything. Took them forever to get back with me about it though.

I had enough sense to not blow in the machine so there was no factual data that I was drunk. Just the field sobriety test and the officers word. I plead no contest and did probation with community service. All standard stuff.

It sounds to me like you got very lucky. I have seen some on this forum (not necessarily from TX) who have very old DUI/DWI and get slapped with three to five years of monitoring.

Yeah, after reading and being a part of this group I realized how rare it was to NOT have to do TPAPN from that DWI. Jokes on me though... cause I'm in TPAPN now. :-/

Thanks so much. I'll know in a few weeks. The weird thing is, the offense happened in WA state before I took my boards and had my license in 2 weeks. Why does it take so long in another state for an offense that happened in 2009?
