Hello everyone,

I just received notice from the Ohio BON that I am to be on probation for an alcohol related offense. I did the crime and will do what I have to do fulfill the probation terms.

My question/concern is, I work as a Quality Assurance manager at a home health agency. One of the probation restrictions is that I "shall not practice nursing as a registered nurse for agencies providing home care in the patient's residence."

I have informed my employee of this and they would like me to take an IT job to assist the company in a different way.

Does anyone know if this would be unacceptable to the BON? I wouldn't supervise nurses or provide patient care.

Thanks for your thoughts! I will of course make sure anything nursing-job-wise would be approved in writing by the BON prior to doing it.

From my understanding, as long as you don't need your RN license in any capacity for the position and aren't being asked to use your nursing skills, the BON has no say in whether you can take the job or not. It only needs approval if you need your license.

Only concern is, at least in California, one of the conditions of probation is you must work as an RN for 6 consecutive months during the 3 year term to complete probation. I assume other BONs have similar rules, so at some point you'll need to get a job where you're working as an RN if you want to complete the program

I understand the home health restriction to be related to the provision of direct patient care. A Quality Assurance Manager or working in IT aren't direct patient care. I'd ask about that provision. No sense in leaving a good job if you don't have to.

I would interpret this to mean YOU cannot practice in the patient's home- not that you cannot work for an agency that provides such care. Only the BON can clarify this- I'm not a lawyer and I don't play one on TV.
