you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

Read what Tom Lantos (Who introduced the new bill) comments about the current critical RN shortage situtation. Also it can be noted that he is memeber of "International Relations Committee".

Yes, I have read it a few days ago, Mr. Lantos has filed that bill H.R. 139 a couple of days after the AHA( American Hospital Association) has filed a letter of protest to the Senate. THANKS!!!

Mine (I-140) was filed in 2003 on California which was slowest at that time. It was approved exactly 11 months later last October. My employer has already paid the visa fee bills in December but according to the lawyer the visas processing for my wife and children will have to wait once our priority dates will become current.

It is a long wait for both of us. Thank you for the sites as it gives as a glimmer of hope for fast processing.

Hello there! I am also a nurse here in the philippines currently waiting for the papers to move. I myself is on the final stage of immigration process. I have forwarded my DS230 last august then in November was asked to send additional papers to NVC (authenticated birthcertificate). Actually I'm waiting for the Packet IV to arrive then suddenly the news of retrogression hit and i'm so confuse if my papers will still move forward or how long am i going to wait. I resigned from work 5 months ago because i'm preparing to take NCLEX in SAipan the only remaining exam that i have to pass. I'm really confuse about this.

you are in good shape. processing of your papers is not affected by the new policy because it was already filed with the USCIS prior to the effectivity of the "regression" which is jan 1, 2005. those that are greatly affected are those I-140 received by USCIS on jan 1, 2005 onwards wherein the concurrent applications of I-485 and I-765 are not now allowed. let us just hope for a positive action on those letters sent by AHA and the others so our friends who applied later may also be able to process faster.

Hi all! I'm also a nurse from the philippines. My case was approved June 8, 2004 and was received by NVC June 28, 2004. Administrative processing was completed December 21, 2004. There was a delay somewhere along the way... my guess is payment of the IV bills. :o The immigration lawyer told me that I will still have to wait for the priority dates to be current (mine is April 14, 2004... such a long way to go :crying2: ). If not for the retrogression, I would just be waiting 2-3 months for the medical exam and consular interview. Right now I'm reviewing for the NCLEX which I will be taking in March or April of this year in Saipan. I hope by then a visa number will be available for me. I'll be monitoring approval of the bill of Mr. Lantos. All I can do now is wait.

thanks for your hopeful words. Its been a while and my papers have been proceesed by the NVC last jan 14 2005 they said i have to wait 8 weeks well it might be 2 or three years because of the retrogression. I have recently passed the NCLEX RN exam took in Saipan last Jan. 27. I hope that everything will turn out good for the nurses.

This is good news. I hope among the names you mentioned are republican members of the congress. Yes, there was no co-sponsor that is why someone said in an article I read it would die naturally and not acted upon unless somebody co-sponsored and is a member of the republican party.
