Entering US on B1/B2 visa with pending EB3

Hello everyone!

I just want to hear your thoughts and advice.

I have an approved EB3. My priority date is May 1, 2008. Just recently, I applied for a tourist or B1/B2 visa; luckily, it was granted. Despite full disclosure of my petition, I was still given a 10-yr multiple entry visa.

Now, I plan to enter the US with my family on B1/B2 for tourism and vacation purposes. Are there ways to live and work there legally until such time that my priority date becomes current?

Thank you!

Thank you for all your insight guys! Point well taken ;)

@steppybay I'm also from the Philippines. Yes I absolutely don't wanna jeopardize my petition and put it to waste. I guess I'll just have to wait for my PD to become current here in the Philippines.

Thanks heaps!!!

I wanted to update the event. I mentioned "forever", it's not quite that, but pretty close. I got an e-mail from my friend about what's happened with a bit more details. Her brother has been banned from applying for any visa to the States for 10 years.

After the 10 years ends, he will be allowed to re-apply, but he will have to wait out whatever the retrogression period is at that time. So in his case, he has another 7 years to go before he can place an application for a visa, then assume today's retro time line, it could be another 13 plus years.

There will be consequences. The days of adjustment of status by eager tourists is a thing of the past. There is no demand now.
