Legal issue about RN's and start of care for OASIS.

If an RN does an Oasis Start of care for a client and a shady agency says they will send an LPN out to do follow up but the care is never given is the RN's liscesne at stake? Given the RN has worked for the HH agency for 2 weeks and it's a first ever job. How does the RN protect him/herself?

It falls on the agency to make sure future visits are made. I have been the admissions nurse at 2 different agencies, once I complete my documentation and give report to the office, if needed, then I'm done. If they would like me to do a revisit, then for that visit I have a responsibility to the patient and agency, but again, when I'm done with that visit and any necessary follow-up, then I'm done. I'm not the one billing the patient/insurance for visits, I am an employee of that agency, therefore the agency needs to make sure visits were made and properly documented that THEY are billing for. No, I have never felt my license was or would be in jeopardy if the agency did not provide service for whatever reason beyond my Oasis SOC.

However, if you think the agency is shady already, then you shouldn't be part of that, because if you KNOW they are billing for visits that are not being performed, then you have a responsibility I would think to report it to Medicare or whoever.
