I have a class c misdemeanor of resisting arrest from the Summer of 2018. I’ve already graduated and the Texas BON has my fingerprints. Due to my positive background check my application is now under review by the enforcement department which means it would take anywhere from 30 to 90 days to hear anything back. I actually took matters into my own hands recently and sent certified court documents to help expedite the process as I am under an extreme time crunch due to my nurse residency position starting later this month. With this type of offense, could I be barred from obtaining my license? And how should I approach the hospital offering me a position when it comes to this matter? I’m very stressed out and it seems there’s isn’t anything I can actually do so any advice helps!

I know this happened a while ago but just a question- how did this resolve with the BON? Did you have any issues with getting into your residency program with a background, or just testing issues?

So this issue did eventually resolve. It took about 3 months and I did not get to join the cohort I was originally assigned to due to the prolonged nature of what a positive background check entails. That being said, no I had no issues getting into residency programs and actually got to choose between two really great hospitals. I communicated with my recruiters and with the managers on the unit of my choice and we reach an understanding which allowed me to join with the next cohort. Everyone’s case is different abs it really just depends on the severity of your charge. Mine was actually disorderly conduct and not resisting arrest so I hope this answers your question.
Thank you! Form my understanding I don’t have a boards issue. Just worried about communicating what happened with the two residency programs I got into. Mine was related to a fake ID. I did not get a conviction but they gave me what is called a prayer for judgement continued. This also happened three years ago. Just worried about them pulling my offers since it will show up in a background check
